1. Agreeing to these terms

These Terms are an agreement between you and Bud Bros LLC. By creating an account or using bagboy, you agree to them and to our Privacy Policy and Community Guidelines. If you don't agree, don't use bagboy.

2. Who can use bagboy

You must be at least 18. The drinking features (chug alerts, drink rules and anything like them) are only for people 21 and older and only where drinking is legal for you. You're responsible for your account and for keeping your Apple or Google sign-in secure.

3. What bagboy is — and isn't

• bagboy is a scorekeeping, game-tracking and social app for golf. It records the games your group sets up, works out the results, and shows who owes who.
• bagboy never holds, collects, transfers or pays out money. It is not a sportsbook, it does not accept wagers, and it does not take a cut. When you settle up, bagboy can open Venmo (or another app) with the details filled in — you decide whether to send anything, and that transaction is between you and the other player under that app's terms.
• Any wager is a private arrangement between the players who agree to it. You are responsible for knowing and following the laws that apply to you. Don't use bagboy where friendly wagering on your own play isn't legal.
• bagboy's math is only as good as the scores entered. Check the card. Results, handicaps and GPS distances are provided for convenience and may not be exact.

4. Drinking features

Drinking features are optional. Every player chooses whether they're drinking, and a designated driver is never called. Nobody ever has to drink — anyone can decline or sit out. Drink responsibly, know your limits, and never drink and drive. If your group turns on a penalty for declining a chug, that's your group's game setting, and it only changes the scorecard.

5. Your content

You own what you post. You give us a license to host, store, display and share it inside bagboy so the app can work (for example, showing your post to your friends and crews). You're responsible for what you post and must have the right to post it.

6. Zero tolerance for objectionable content and abusive users

bagboy has zero tolerance for objectionable content or abusive behavior. Don't post anything that is hateful, harassing, threatening, sexually explicit, violent, illegal, or that shares someone's private information — see the Community Guidelines. You can report any post, comment or person and block anyone from inside the app. We review reports within 24 hours, remove content that breaks these rules, and remove users who post it.

7. Acceptable use

Don't misuse bagboy: no cheating the system, scraping, reverse engineering, interfering with the service, impersonating others, or using bagboy for anything illegal.

8. Third-party services

bagboy works with Apple, Google, Venmo, Apple Maps and course-data providers. Their services are governed by their own terms, and we aren't responsible for them.

9. Ending your account

You can delete your account at any time in the app (Profile → Settings → Delete Account) or on our deletion page. We may suspend or remove accounts that break these Terms.

10. Disclaimers

bagboy is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee bagboy will be uninterrupted or error-free, or that scores, results, distances or amounts will be accurate.

11. Limitation of liability

To the fullest extent the law allows, Bud Bros LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, data or goodwill, including any money won, lost or owed between players. Our total liability for any claim is limited to $50.

12. Indemnity

You agree to defend and hold harmless Bud Bros LLC from claims arising from your content, your wagers and settlements with other players, your drinking, or your breaking these Terms.

13. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Arizona.

14. Apple

If you downloaded bagboy from the App Store: these Terms are between you and Bud Bros LLC, not Apple. Apple has no obligation to provide maintenance or support, and isn't responsible for claims about bagboy (including product liability, legal compliance, or intellectual-property claims). If bagboy fails to conform to any warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you're not in a country subject to a U.S. embargo and not on a U.S. government list of prohibited parties.

15. Changes

We may update these Terms. If a change is significant we'll tell you in the app. Continuing to use bagboy means you accept the updated Terms.
